TERMS AND CONDITIONS

1. General
By downloading or using the Sensiplan+ (the app), these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. Wonderlife d.o.o. owns all rights (hereinafter called ‘we’, ‘us’, ‘our’) to the intellectual property and material contained in the Sensiplan+ and in the web page and all such rights are reserved.

2. Sensiplan+ features
Sensiplan+ is a personal app for evaluating your best time for conception and tracking your overall health. It's based on sympto -thermal Sensiplan rules for tracking fertility.

Optimal calculation of fertility/infertility is achieved (and not garanteed ) by appropriate observation and daily inputs of all important parameters (basal body temperature, cervical muxus (feeling and appearance), cervix (position and feeling), bleeding, disturbance, health, etc.

Sensiplan+ can automatically processes your data according to the sympto -thermal Sensiplan rules. More information about the app and the Sensiplan rules you could get at/on the webpage sensiplan.de and in the book " Naturliche und sicher , Das Praxisbuch , Familienplanung mit Sensiplan, TRIAS Verlag, 2015".

3. Subscription rules
The app is free to use in Young Girl and Teenager modes until user turn 20. After that, only the WOMAN mode is available. In Woman mode, user get three cycles of free access, and after completing the third cycle, a subscription (monthly or yearly based) is required to keep on using premium features like daily fertility determination, personalized notifications, standardized report,...

4. Payment Terms
Payment Processing
Payments for membership/subscriptions are processed directly through the applicable app marketplace (Apple App Store or Google Play Store) via your user account registered with that marketplace. The marketplace operator’s payment system is used. Where the marketplace operator applies its own terms and conditions, those terms apply exclusively to payment processing. Tapping the purchase button in the Sensiplan+ does not by itself conclude a contract for paid use; the subscription is formed only once the marketplace operator confirms the transaction. Subscription fees are charged through your marketplace account.

Free Trials
Your subscription to Sensiplan+ may start with a free trial period. There is no entitlement to a free trial. We reserve the right to withdraw or change trial offers at any time. Trials are generally offered to new users only. You can cancel the subscription at any time before the end of the trial through your marketplace operator. If you do not cancel in accordance with the cancellation rules, the first payment becomes due immediately after the trial ends. You will be informed of the trial duration when subscribing. You may not receive a separate reminder about the end of the trial or the start of paid billing.

Automatic Renewal
After the free trial ends, your access will automatically continue under the paid version. Your Sensiplan+ subscription renews automatically for successive subscription periods unless you cancel it in advance as described under “Cancellation.” You will be informed about automatic renewal during the purchase flow, and you may also receive a notification from your marketplace operator. If the subscription renews, your account is typically charged within 24 hours before the end of the current subscription period.

Cancellation
You may cancel your subscription at any time in accordance with the marketplace rules. Billing, subscription management, and cancellation are handled exclusively through your user account in the Apple App Store or Google Play Store. If you have an active subscription, cancellation takes effect at the end of the current subscription term. After the subscription ends, access to paid features of Sensiplan+ will no longer be available.

Right of Withdrawal
The right of withdrawal is governed by the terms of the relevant marketplace operator. Refunds of payments made via the Apple App Store or Google Play Store cannot be issued by the provider of Sensiplan+ ; the marketplace operator’s terms apply.

Refunds
As a rule, the provider of Sensiplan+ does not issue refunds for subscription purchases. If the app does not work as expected or a purchase was made by mistake (for example by a family member), you may be eligible for a refund under the marketplace operator’s policies. Any refund request must be submitted directly to the marketplace operator; please review their applicable refund rules.

5. Disclaimer for use
Note that Sensiplan+ is intended solely for recording your cycle observations. The evaluations suggested by the app are based on the data you enter and are meant as recommendations only. Reliable and safe interpretation of your observations is only possible if you have fully learned the Sensiplan rules. The final review and assessment of the results always remain with you as the user—the app cannot and should not replace your personal decision-making process. We will not promise that you can achieve pregnancy by using Sensiplan+ or that you can find your fertile days with absolute certainty. Our app will help you find out more about your body and your cycles. Sensiplan+ is not a certified contraceptive app! If you disagree with these terms, please do not use the Sensiplan+ .

We are not responsible for improper use and quality of your basal body thermometer that you need for using the app. Choosing your thermometer for the symptothermal method is more a matter of preference than effectiveness, as digital and analogue thermometers do not differ significantly in quality. If you prefer a digital thermometer, make sure it is tested (CE marked) and displays the result to two decimal places – one decimal place is not precise enough for the symptothermal method. The thermometer must also have a specified measurement accuracy of ±0.05 °C or better.

The app achieves its effectiveness only with appropriate and consistent use and with appropriate basal body thermometer. We are not responsible for unwanted conception or failure to conceive.

Sensiplan advisors or any other employees at Wonderlife d.o.o, shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of the app or the website.

6. Medical Notice
Sensiplan+ and any related information are provided for cycle tracking and educational purposes only and do not replace medical advice, diagnosis, or treatment. The app, website, and any embedded software are not standalone contraceptive methods and must not be relied on as the sole means to prevent or achieve pregnancy. If you have health concerns, unusual symptoms, or questions about your wellbeing, please consult a qualified healthcare professional promptly rather than starting, changing, or stopping treatment on your own. The online content is not intended for self-diagnosis or for selecting and applying treatment methods; any such use is at your own risk.

7. Copyright and Intellectual Property
The content of the Sensiplan+ is protected by copyright and other intellectual property rights . Any content made available through the Sensiplan+ or our website — including images , product images , text , graphics , tables , videos , music , and databases — may not be copied , reproduced , distributed , modified , publicly communicated , transmitted , translated , adapted , or otherwise used (in whole or in part) without the prior express written consent of Wonderlife d.o.o. You may , however , download , store, or print content from the website for strictly private , non- commercial use .

Removing or altering copyright notices , trademarks , or other proprietary rights notices is prohibited . All product names and logos displayed in the Sensiplan+ or on our websites , regardless of font size or whether a trademark symbol is shown , are trademarks of Sensiplan or Wonderlife d.o.o., their affiliated companies , licensors / licensees , or their respective owners . Any unauthorized use of these trademarks is not permitted and may be pursued under applicable law .

8. Technical disclaimer
You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Wonderlife d.o.o.

Wonderlife d.o.o. is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

9. Data management
The Sensiplan+ stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the the Sensiplan+ won’t work properly or at all.

You should be aware that there are certain things that Wonderlife d.o.o. will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Wonderlife d.o.o. cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, Wonderlife d.o.o. cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Wonderlife d.o.o. cannot accept responsibility.

With respect to Wonderlife d.o.o.’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Wonderlife d.o.o. accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

For the backup of your data you should take resposibility by your own. All the input data (at registration or at regular use) are stored in your device and we do not provide back-up. 10. Availability of the Sensiplan+
We aim to make the Sensiplan+ available on a continuous basis. However, maintenance work, updates, and technical issues may result in the service being temporarily unavailable or limited. In addition, no entitlement to service, compensation, or a reduction of subscription fees exists in the event of internet connectivity issues caused by force majeure, third-party network disruptions, or other circumstances beyond our reasonable control. Temporary interruptions may also occur due to routine maintenance windows or inherent internet/network issues with external service providers. We do not guarantee uninterrupted online availability, and you may not claim compensation for service interruptions or system outages.

11. Questions, Bug Reports, and Suggestions
If you notice malfunctions, error messages, or other issues while using the Sensiplan+ , or if you have improvement suggestions and/or questions not answered in our FAQs, please contact us by email info@SensiplanApp.eu. If possible, include a brief description of the issue and, where helpful, a screenshot or video.

12. Update
At some point, we may wish to update the Sensiplan+ . The app is currently available on Android & iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Wonderlife d.o.o. does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

We are not liable for any unauthorized access and content by third parties on website, for a transfer of viruses, worms, Trojan horses or other harmful elements. You yourself should meet measures to protect your PC or laptop from malware (with a firewall and antivirus software).

13. Indemnification
You agree to indemnify and hold harmless the provider of the Sensiplan+ from any losses, damages, and claims (including reasonable legal defence costs to the extent permitted by law) arising from your unlawful conduct or breach of these Terms, or from the infringement of third-party rights in connection with your use of the Sensiplan+ and related services.

14. Final Provisions
If any provision of these Terms (including this provision) is or becomes wholly or partly invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid or missing provision, the applicable statutory provisions shall apply.

15. Changes to This Terms and Conditions
We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.
